OVERVIEW
This online store is operated by Fastiro Limited, trading as NordLuca. The terms “NordLuca”, “we”, “us” and “our” refer to Fastiro Limited.
Fastiro Limited provides this website, including its information, content, features, products and services, through the Shopify ecommerce platform.
These Terms of Service, together with the policies referenced in them, govern your use of nordluca.com and any order submitted through the website.
By accessing or using the website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the website.
Nothing in these Terms excludes, restricts or limits any mandatory consumer right that cannot lawfully be excluded or limited.
SECTION 1 — ELIGIBILITY, ACCESS AND CUSTOMER ACCOUNTS
You must have the legal capacity required under the law of your country of residence to enter into a contract.
When using the website or submitting an order, you must provide accurate, current and complete information. You are responsible for keeping your account credentials secure and for activity carried out through your account.
You must not transfer, sell or assign your customer account to another person without our prior written consent.
SECTION 2 — PRODUCTS, AVAILABILITY AND CONDITION
We make reasonable efforts to describe and display our products accurately. However, colours and appearance may vary depending on screen settings, lighting and photography.
Many products offered by NordLuca are unique, outlet, showroom, display, last-chance or limited-stock items. Availability is therefore subject to confirmation.
Where a product has visible marks, signs of display, packaging damage, minor cosmetic imperfections or other specific characteristics, these will be disclosed in the product description or during order confirmation. Disclosed characteristics that the customer expressly accepts form part of the agreed product condition.
A disclosed characteristic is not an undisclosed defect. This does not affect the customer’s statutory rights if the product is damaged, unsafe, incorrectly supplied or otherwise fails to conform to the sales contract.
We may correct product information, withdraw a product or limit quantities before an order is accepted.
SECTION 3 — ORDERS AND CONTRACT FORMATION
Submitting an order through the website is a request to purchase and does not by itself create a binding sales contract.
The automatic order acknowledgement confirms only that we have received the request. Because many products are unique or limited in quantity, NordLuca will contact the customer to confirm:
- product availability;
- the disclosed product condition;
- the final product price;
- applicable taxes;
- delivery availability and cost;
- the estimated delivery time;
- access, handling or assembly requirements, where relevant; and
- the agreed payment method.
No online payment is collected during checkout.
A binding sales contract is formed only after NordLuca confirms the final order details and the customer accepts those details by email, telephone, WhatsApp or another agreed means of communication.
Before acceptance, NordLuca may decline an order, including where a product is unavailable, information or pricing contains a material error, delivery cannot reasonably be arranged, or the order appears fraudulent or unlawful.
The customer should review all confirmed order details carefully and notify us immediately of any error.
SECTION 4 — PRICES, TAXES AND PAYMENT
Prices are displayed in euros.
For consumer sales, the final price confirmed before the contract becomes binding will include applicable VAT and any other mandatory taxes. Delivery, assembly and optional service charges are not included unless expressly stated.
Where delivery or another charge cannot reasonably be calculated in advance, NordLuca will provide the amount, or the method of calculating it, before the customer becomes bound by the order.
No additional charge will be applied without the customer’s express agreement.
Payment is arranged separately after order confirmation using the payment method agreed between NordLuca and the customer. The payment terms and any required deposit will be communicated before the sales contract becomes binding.
Prices, promotions and discounts may change before an order is accepted. After a binding contract is formed, the agreed price will not be changed unless both parties expressly agree.
SECTION 5 — SHIPPING AND DELIVERY
Delivery availability, charges and estimated delivery times are confirmed before the order becomes binding.
Unless another delivery period is expressly agreed, goods will be delivered without undue delay and no later than 30 days after the sales contract is concluded.
Delivery dates and times are estimates unless NordLuca expressly agrees that a particular date is essential.
The customer must provide complete and accurate delivery information and disclose any relevant access restrictions, including stairs, lifts, narrow entrances, parking restrictions or special handling requirements. Additional costs caused by incomplete or inaccurate information may be charged only where they are reasonable and communicated to the customer.
NordLuca remains responsible for loss of or damage to the goods until the customer, or a third party designated by the customer other than the carrier, takes physical possession of them.
This does not apply where the customer independently appoints a carrier that was not offered by NordLuca.
The customer should inspect the external packaging and visible condition of the goods at delivery. Visible transport damage should be noted on the carrier’s delivery record and reported to NordLuca as soon as reasonably possible, preferably with photographs. Failure to note visible damage does not remove any mandatory statutory right.

SECTION 6 — CANCELLATION, WITHDRAWAL, RETURNS AND REFUNDS
Consumers may have a statutory right to withdraw from a distance contract within 14 days, subject to applicable law and statutory exceptions.
The right of withdrawal may not apply to goods made to the customer’s specifications or clearly personalised, and to other categories excluded by applicable law.
Outlet, showroom, display, discounted and last-chance products are not excluded from statutory withdrawal rights solely because of their price or sales category.

Nothing in these Terms limits statutory remedies for defective, damaged, unsafe, incorrectly supplied or non-conforming goods.
SECTION 7 — LEGAL GUARANTEE AND PRODUCT CONFORMITY
Goods supplied by NordLuca must conform to the sales contract, the agreed description and the condition disclosed before purchase.
Consumers in the European Union benefit from the legal guarantee and remedies provided by applicable consumer law. These rights are separate from and additional to any commercial warranty offered by a manufacturer.
Where goods do not conform to the contract, the customer may be entitled to repair, replacement, price reduction or termination of the contract and a refund, subject to applicable law and the circumstances of the case.
No wording in these Terms, including references to outlet, showroom, display or “as available” products, excludes statutory rights relating to defects or lack of conformity.
SECTION 8 — CUSTOMER RESPONSIBILITIES
The customer must use products in accordance with supplied instructions, warnings and intended use.
The customer is responsible for checking dimensions, access routes and suitability for the intended location before accepting the final order details.
NordLuca is not responsible for problems caused solely by incorrect measurements, unsuitable access information or misuse supplied by the customer, except where NordLuca expressly agreed to measure, assess or advise on those matters.
SECTION 9 — WEBSITE USE AND PROHIBITED ACTIVITIES
You may use the website only for lawful personal or commercial purposes consistent with these Terms.
You must not:
- use the website for unlawful, fraudulent or malicious activity;
- infringe intellectual property, privacy or other rights;
- upload or transmit malicious code;
- interfere with website security or operation;
- scrape, copy or extract website content through unauthorised automated means;
- impersonate another person;
- submit false or misleading information; or
- use the website in a manner that may harm NordLuca, Shopify or other users.
We may restrict or suspend access where reasonably necessary to protect the website, users or our legal rights.
SECTION 10 — INTELLECTUAL PROPERTY
Unless otherwise stated, the website content, including text, branding, logos, graphics, product images, videos, layout and design, is owned by or licensed to Fastiro Limited and is protected by applicable Maltese, European Union, Spanish and international intellectual property laws.
You may view and use the website for personal, non-commercial purposes. You must not reproduce, distribute, modify, republish, commercially exploit or create derivative works from website content without prior written permission, except where permitted by law.
Shopify’s name, trademarks and platform materials remain the property of Shopify or its licensors. Other third-party names and trademarks belong to their respective owners.
SECTION 11 — THIRD-PARTY SERVICES AND LINKS
The website may include services, applications, links or content provided by third parties, including Shopify, payment providers, delivery providers, analytics services, social media services and WhatsApp.
Third-party services are governed by their own terms and privacy notices. NordLuca is not responsible for third-party websites or services outside our reasonable control.
Nothing in this section excludes liability that cannot lawfully be excluded.
SECTION 12 — RELATIONSHIP WITH SHOPIFY
NordLuca uses Shopify to host and operate the online store.
Any sale made through the store is made directly between the customer and Fastiro Limited, trading as NordLuca. Shopify is not the seller of NordLuca products and is not responsible for product descriptions, order acceptance, delivery, customer service, returns or refunds.
SECTION 13 — PRIVACY AND COOKIES

Because the store is hosted by Shopify, personal information may be processed by Shopify and other service providers where necessary to operate, secure and improve the store.
Information about cookies and consent choices is provided through the website’s privacy and cookie settings.
SECTION 14 — CUSTOMER REVIEWS AND SUBMISSIONS
Where you submit a review, image, comment, suggestion or other content, you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person’s rights.
You grant NordLuca a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating and promoting the business, subject to applicable privacy and consumer law.
We may remove unlawful, misleading, abusive or infringing content.
SECTION 15 — ERRORS AND CORRECTIONS
The website may occasionally contain typographical errors, inaccurate information or omissions relating to product descriptions, availability, prices, delivery charges or estimated times.
We may correct such information before an order is accepted.
If a material error is identified after an order request but before acceptance, we will inform the customer and allow the customer to proceed with corrected information or cancel the request.
Nothing in this section permits NordLuca to unilaterally change a binding sales contract contrary to applicable law.
SECTION 16 — WEBSITE AVAILABILITY AND DISCLAIMERS
We aim to keep the website available, accurate and secure, but we do not guarantee uninterrupted or error-free access.
General website information is provided for informational purposes and should not replace product-specific information confirmed as part of an order.
Any reference to the website or digital services being provided “as is” or “as available” applies only to the operation and availability of the website. It does not exclude or limit statutory rights concerning goods sold by NordLuca.
SECTION 17 — LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- wilful misconduct or gross negligence;
- death or personal injury caused by negligence;
- defective products;
- breach of mandatory consumer rights; or
- any liability that cannot lawfully be excluded or limited.
For consumers, NordLuca remains liable as required by applicable law for foreseeable loss caused by a breach of contract or legal duty.
NordLuca is not liable for loss caused solely by events outside its reasonable control, provided that this does not limit any mandatory right relating to delivery, refunds, product conformity or consumer protection.
Where the customer purchases wholly for business purposes, any additional limitation of liability must be agreed separately in writing.
SECTION 18 — TERMINATION OF WEBSITE ACCESS
We may suspend or terminate access to the website where a user materially breaches these Terms, acts unlawfully, threatens website security or misuses the Services.
Termination of website access does not affect rights and obligations arising from an existing sales contract or any provision intended to survive termination.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be applied to the maximum extent permitted or removed where necessary. The remaining provisions will continue in effect.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
A failure or delay by NordLuca to enforce a right does not waive that right.
These Terms, the confirmed order details and the policies incorporated by reference form the agreement governing use of the website and the relevant sale, subject to mandatory law.
If there is a conflict between these Terms and the final order confirmation, the final order confirmation takes priority for the specific transaction, except where this would reduce a mandatory consumer right.
SECTION 21 — ASSIGNMENT
The customer may not transfer contractual rights or obligations without NordLuca’s prior written consent, unless applicable law provides otherwise.
NordLuca may transfer its rights or obligations only where this does not reduce the customer’s rights or legal protections.
SECTION 22 — GOVERNING LAW AND JURISDICTION
These Terms and sales contracts concluded with Fastiro Limited are governed by the laws of Malta.
If the customer is a consumer, this choice of law does not deprive the customer of protection provided by mandatory laws of the country in which the customer has their habitual residence, where those laws apply under European Union rules.
Nothing in these Terms limits a consumer’s right to bring proceedings before any court having jurisdiction under applicable national or European Union law.
SECTION 23 — CHANGES TO THESE TERMS
The current version of these Terms is published on this page.
We may update these Terms from time to time for legal, regulatory, technical or operational reasons. Material changes will be communicated where required by applicable law.
Changes do not retroactively alter a sales contract already concluded unless both parties agree or the law requires otherwise.
SECTION 24 — LANGUAGE
These Terms may be made available in more than one language.
Where translations are provided, they are intended to have the same meaning. If there is a discrepancy, the interpretation that best preserves the customer’s mandatory rights and the parties’ confirmed agreement will apply.
