1. General Provisions
1.1
These Terms of Service and Purchasing Rules (the “Terms”) govern the purchase and sale of products through the NordLuca online store available at nordluca.com (the “Online Store”).
These Terms set out the rights and obligations of the Buyer and the Seller, including the conditions relating to ordering, payment, delivery, withdrawal, returns, product quality and dispute resolution.

Hereinafter referred to as the “Seller”, “NordLuca”, “we”, “us” or “our”.
1.3 Buyer and Consumer
A “Buyer” is any natural or legal person who places an order through the Online Store.
A “Consumer” is a natural person purchasing products for purposes outside their trade, business, craft or profession.
Certain rights described in these Terms apply only to Consumers.
1.4 Acceptance of the Terms
By placing an order, the Buyer confirms that they have read, understood and accepted these Terms, as well as the applicable Privacy Policy, Shipping Policy and Return Policy.
The Buyer must be legally capable of entering into a binding contract.
2. Products
2.1 Product information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials, colours and other information displayed in the Online Store are accurate.
However, colours may appear differently depending on the Buyer’s device and display settings.
2.2 One-off, showroom and last-collection products
NordLuca’s assortment may include:
-
one-off products;
-
last-collection items;
-
showroom or exhibition items;
-
returned products;
-
products with damaged packaging;
-
products with minor cosmetic marks or imperfections.
Any known material defect or visible damage will be described in the product listing and/or shown in the product photographs where reasonably possible.
The purchase of a product with a clearly disclosed defect does not affect the Buyer’s rights regarding defects that were not disclosed before purchase.
2.3 Natural materials
Products made from wood, stone, marble, leather or other natural materials may differ slightly from the photographs.
Differences in grain, colour, texture, veining, knots and other natural characteristics are not necessarily defects. Each item may be unique.
2.4 Product availability
Many products are available in limited quantities or as a single unit.
Adding a product to the shopping cart does not reserve it. A product is reserved only after the Seller has confirmed the order.
If a product becomes unavailable after an order has been placed, the Seller will notify the Buyer and refund any payment received for that product.
3. Prices and Taxes
3.1
Product prices are displayed in euros (EUR).
Unless stated otherwise, prices include VAT where VAT is applicable.
3.2
Delivery charges are not included in the product price unless expressly stated.
The applicable delivery charge may be:
-
displayed during checkout;
-
calculated according to the delivery address;
-
or confirmed separately by the Seller for oversized, heavy or special-delivery products.
3.3
The Seller may change product prices at any time. Changes do not affect orders already accepted by the Seller.
3.4 Pricing errors
If a product is displayed with an obvious pricing or technical error, the Seller may cancel the affected order before dispatch.
The Buyer will be informed and any amount paid will be refunded.
4. Placing an Order and Formation of the Contract
4.1
To place an order, the Buyer must:
-
add the selected product to the shopping cart;
-
provide accurate contact and delivery information;
-
select an available delivery and payment method;
-
accept these Terms;
-
submit the order by clicking the relevant checkout button.
4.2
An automatically generated email confirming receipt of an order does not necessarily mean that the order has been accepted.
4.3
The purchase contract is concluded when the Seller sends the Buyer an explicit order confirmation confirming:
-
product availability;
-
the final price;
-
the applicable delivery cost;
-
and acceptance of the order.
Where delivery costs must be calculated separately, the Seller may contact the Buyer before accepting the order.
4.4
The Seller may refuse or cancel an order where:
-
the product is unavailable;
-
the Buyer’s information is incomplete or incorrect;
-
payment cannot be verified;
-
delivery to the provided address is not possible;
-
there is a suspected fraudulent or abusive transaction;
-
or an obvious technical or pricing error has occurred.
Any payment already received for a cancelled order will be refunded.
4.5
The Buyer is responsible for ensuring that all information provided during checkout is complete and accurate.
5. Payment
5.1
The Buyer may use the payment methods available in the Online Store at the time of checkout.
Available methods may include:
-
payment card;
-
bank transfer;
-
cash on delivery;
-
or another payment method offered by the Seller.
5.2 Cash on delivery
Where cash on delivery is available:
-
the order may be subject to additional confirmation;
-
the Buyer must pay the agreed amount to the courier or delivery representative;
-
cash on delivery may not be available for every country, address or oversized product;
-
the Seller may contact the Buyer before dispatch.
5.3
For prepaid orders, processing normally begins after payment has been successfully received or authorised.
5.4
The Buyer must pay all amounts shown in the confirmed order, including any agreed delivery charges.
6. Delivery
6.1
Products are delivered only to countries and regions supported by the Online Store and the applicable delivery profile.
6.2
Estimated delivery periods are provided for information only unless a specific binding delivery date has been expressly agreed in writing.
Delivery times may be affected by:
-
product dimensions and weight;
-
the delivery country and address;
-
courier availability;
-
customs or local restrictions;
-
public holidays;
-
weather conditions;
-
and circumstances beyond the Seller’s reasonable control.
6.3 Large and heavy products
Furniture, marble products and other oversized or heavy items may require special handling, pallet delivery, kerbside delivery or additional assistance from the Buyer.
The Seller will inform the Buyer of any specific delivery conditions before confirming the order where reasonably possible.
6.4 Access to the delivery address
The Buyer must ensure that:
-
the delivery address is correct;
-
the product can pass through doors, stairways, lifts and corridors;
-
access is available for the delivery vehicle;
-
and an authorised person is present to receive the shipment.
Additional costs caused by incorrect information, failed delivery or inaccessible premises may be charged to the Buyer where permitted by law.
6.5 Inspection upon delivery
The Buyer should inspect the external condition of the shipment at the time of delivery.
Visible damage, missing packages or damaged packaging should be:
-
noted on the carrier’s delivery document;
-
photographed;
-
and reported to the Seller as soon as reasonably possible at info@nordluca.com.
Failure to report visible transport damage immediately does not remove any mandatory consumer rights, but prompt reporting helps the Seller investigate the matter with the carrier.
6.6 Risk
For Consumers, the risk of accidental loss or damage generally passes to the Consumer when the Consumer, or a person designated by the Consumer other than the carrier, receives the goods.
7. Right of Withdrawal
7.1 Fourteen-day withdrawal period
A Consumer generally has the right to withdraw from a distance purchase without providing a reason within 14 days from the day on which the Consumer, or a third party designated by the Consumer other than the carrier, receives the product.
Where an order contains multiple products delivered separately, the period generally begins when the final product is received.
7.2 Exercising the right of withdrawal
To exercise the right of withdrawal, the Consumer must send a clear statement to:

The statement should include:
-
the Consumer’s name;
-
order number;
-
product being returned;
-
date of receipt;
-
and a clear statement that the Consumer wishes to withdraw from the contract.
The Consumer may use the withdrawal form included in the Return Policy, but use of that form is not mandatory.
7.3 Returning the product
After notifying the Seller of withdrawal, the Consumer must return the product within 14 days, unless the Seller has agreed to collect it.
The product must be returned to the address provided by the Seller. Products must not be sent to the registered office without prior confirmation.
7.4 Return costs
Unless the product is defective, damaged, incorrect or otherwise non-conforming, the Consumer is responsible for the direct cost of returning the product.
Return costs for furniture, marble tables and other oversized products may be significant.
7.5 Condition of returned products
The Consumer may inspect the product in the same way as they reasonably could in a physical shop.
The Consumer may be responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
Where reasonably possible, the product should be returned:
-
complete;
-
with all parts and accessories;
-
securely packaged;
-
and in its original packaging.
7.6 Refunds
Where a valid withdrawal is exercised, the Seller will refund the payments received in accordance with applicable law.
The Seller may withhold the refund until:
-
the returned product has been received;
-
or the Consumer provides evidence that the product has been sent back,
whichever occurs first, where permitted by law.
Refunds will normally be issued using the original payment method unless otherwise agreed.
7.7 Exceptions
The right of withdrawal may not apply in circumstances provided by law, including certain:
-
made-to-order or clearly personalised products;
-
sealed products that are not suitable for return for health protection or hygiene reasons after being unsealed;
-
products that become inseparably mixed with other goods after delivery.
An exception applies only where the legal requirements for that exception are met.
8. Defective, Damaged or Incorrect Products
8.1
If a product is defective, damaged during delivery, materially different from its description or otherwise not in conformity with the purchase contract, the Buyer should contact the Seller at info@nordluca.com.
8.2
The Buyer should provide:
-
the order number;
-
a description of the problem;
-
photographs or video showing the issue;
-
photographs of the packaging where transport damage is involved;
-
and any relevant delivery documentation.
8.3
Depending on the circumstances and applicable law, the Buyer may be entitled to an appropriate remedy, such as:
-
repair;
-
replacement;
-
price reduction;
-
or refund.
8.4
The Seller is not responsible for damage caused by:
-
incorrect assembly;
-
improper use;
-
failure to follow care instructions;
-
unauthorised repair or modification;
-
improper storage;
-
normal wear and tear;
-
or damage occurring after delivery due to the Buyer’s actions.
Nothing in this section limits mandatory legal rights.
9. Product Care and Assembly
9.1
The Buyer must follow all assembly, maintenance, cleaning, storage and safety instructions provided with the product or included in its description.
9.2
Some products are delivered partially assembled or in space-saving packaging.
The Buyer is responsible for correct assembly unless assembly services have been expressly included in the order.
9.3
Outdoor products must be protected from weather, moisture, frost and direct rain where stated in the product instructions.
10. Personal Data
The Seller processes personal data in accordance with:
-
the General Data Protection Regulation (EU) 2016/679;
-
applicable Maltese data-protection legislation;
-
and the NordLuca Privacy Policy.
The Privacy Policy explains what information is collected, why it is collected, how it is used and the Buyer’s data-protection rights.
11. Liability
11.1
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
11.2
The Seller is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was concluded.
11.3
For Buyers acting in the course of business, the Seller will not be liable for loss of profit, revenue, business opportunity, goodwill or anticipated savings, except where such exclusion is prohibited by law.
11.4
The Seller is not responsible for delays or failure caused by circumstances beyond its reasonable control, including natural disasters, war, transport disruption, strikes, government restrictions, network failures or other force-majeure events.
12. Intellectual Property
All content available through the Online Store, including text, design, logos, photographs, graphics and layout, is owned by or licensed to the Seller and is protected by applicable intellectual-property laws.
Content may not be copied, reproduced or commercially used without prior written permission.
Third-party brand names and trademarks remain the property of their respective owners.
13. Complaints and Dispute Resolution
13.1
The Buyer should first submit any complaint directly to the Seller:

The complaint should include the order number and a clear description of the issue.
13.2
The Seller will attempt to resolve complaints fairly and within a reasonable time.
13.3
Consumers may also contact the Malta Competition and Consumer Affairs Authority (MCCAA) or use an applicable authorised alternative dispute resolution body.
13.4
These Terms are governed by the laws of Malta.
However, a Consumer residing in another country retains any mandatory consumer protections granted by the law of their country of habitual residence where those protections apply and cannot legally be excluded.
13.5
Disputes that cannot be resolved amicably may be submitted to the courts having jurisdiction under applicable Maltese and European Union law.
14. Changes to These Terms
The Seller may update these Terms from time to time.
The version applicable to an order is the version published and accepted at the time the order is placed, unless a change is required by law.
